Alina Habba has resigned as top federal prosecutor in New Jersey, despite the Trump administration's efforts to keep her in the role.
Habba, who previously worked as a personal lawyer for President Donald Trump, was found to be serving unlawfully in the role, which is charged with enforcing criminal and civil law at the federal level.
Her interim position had expired, and she had not received Senate confirmation, a legal requirement for the role.
Despite this, the Trump administration was seeking ways to keep her appointed.
In a social media statement on Monday, Habba confirmed that she had stepped down from the role and would now be serving as senior adviser to the administration’s attorney general, Pam Bondi.
“But do not mistake compliance for surrender. This decision will not weaken the Justice Department and it will not weaken me,” she wrote.
“My fight will now stretch across the country.”
